O R D E R
% 01.05.2018 Learned counsel appearing on behalf of the parties, on instructions from the latter, state that they undertake to abide by the terms of the Memorandum of Understanding, arrived at between them, on 27.02.2017 (annexed as Annexure A-7 at page 95 and exhibited as Ex. P-1) before the learned Family Court, Saket. The parties undertake to take all necessary steps in pursuance of the said Memorandum of Understanding expeditiously and positively within a period of one month from today. Learned counsel appearing on behalf of the parties
further state that they have agreed to modify Clause 2 (a) at page 96 of the Appeal Paperbook in the following manner to provide for the period when Master Rian Prasad and Master Jivin Prasad do not go for the taekwondo class and the cricket coaching respectively, as is the case at this point of time. It is agreed between the parties that as an alternative to the said clause in the said Memorandum of Understanding, the parties have agreed as follows:- Dr. Jayant Prasad (the first party) shall meet Master Rian Prasad and Master Jivin Prasad on Tuesdays and Thursdays in the second and fourth week of the month at Sirifort Sports Complex, New Delhi, between 5 pm to 7 pm subject to modification, if any, by mutual consent.
The statements and undertakings furnished on behalf of the parties as above-stated are hereby accepted, directing them to abide by the same without demur.
In view of the foregoing, Mr. Siddiqui, learned counsel appearing on behalf of the appellant, on instructions from the latter, who is present in person, seeks leave to withdraw the appeal. The appeal along with pending applications is dismissed as withdrawn and disposed off accordingly.
