Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed to challenge the Order dated 06.08.2025 whereby the learned JMFC after recording the pre-summoning Order in a Complaint under Section 200 Cr.P.C., has listed the matter for arguments on 17.11.2025. 2.
The Petitioners, who are appearing in person submit that once the cognizance has been taken, no further arguments are required and the Accused/Respondent should be summoned directly. However, as explained by the Petitioners themselves, they have filed an Application under Section 156(3) Cr.P.C. alongwith the Complaint under Section 200 Cr.P.C., which got dismissed by the learned MM and the Order was upheld by the Revisional Court vide Order dated 10.09.2025.

The pre-summoning evidence has been led by the Petitioners. The arguments are inevitably required to be heard to ascertain whether any case is made out for summoning the Respondents.
