The present Petition has been filed under Section 115 of the Code of Civil Procedure, 1908 [hereinafter referred to as "CPC"] impugning the order dated 13.08.2024 passed by the learned ADJ-0, Central, Tis Hazari Courts, Delhi [hereinafter referred to as "Impugned Order"]. By the Impugned Order, the Application under Order VI Rule 11 of the CPC as well as Order VII Rule 11 of the CPC has been adjudicated upon. 2.

After some arguments, learned Counsel for the Petitioner seeks and is granted permission of the Court to withdraw the present Petition. 3.

The Petition is accordingly dismissed as withdrawn. 4.

It is however clarified that this order has been passed without prejudice to the rights and contentions of the parties which are left open to be agitated before the learned Trial Court.
