In the present Appeal, the Appellant/Defendant assails the correctness of the Order passed by the learned Single Judge in I.A. No. 3028/2025 and I.A. No. 3029/2025 in CS(OS) No. 276/2024. 2.

After making submissions for some time, learned counsel for the Appellant prays for permission to withdraw the Appeal in order to file a fresh application under Order XXXIX Rule 4 of the CPC. 3.

Accordingly, the Appeal is dismissed as withdrawn. 4.
