% 16.05.2016 The decision given by us in Conclave Pharma Pvt. Ltd. v. Govt. of NCT of Delhi & Anr. [WP(C) 1955/2016] today itself would apply to this case also because the facts are virtually identical.

Consequently, the letter dated 03.02.2016 is quashed and the petitioner's bid is to be treated as responsive on the ground for which it was earlier held to be non-responsive.

The writ petition is allowed.
