Present petition has been filed seeking a direction to respondent no.1 - Registrar of Cooperative Society (RCS) to recommend the name of the petitioner to the Rule 90 Committee for approval of membership to the respondent no.2-Cooperative Group Housing Society. 2.

Learned counsel for the petitioner states that respondent no.2 had issued the share certificate to Dr. Kashi Nath Tandon on 15th January, 1986 and Flat no. B in the respondent society was allotted to him on 24th September, 2000. He states that the petitioner has purchased the flat from Dr. Tandon on 19th August, 2005 and membership was transferred in the name of the petitioner vide letter dated 20th October, 2008 issued by the Managing Committee of respondent society.

petitioner. He states that till date the name of the petitioner has not been placed before the Rule 90 Committee for approval of membership despite follow up with the RCS and completing the submission and verification of all requisite documents.

Mr. Udit Malik, learned counsel for RCS states that he has no instructions in the matter.

A perusal of the letter dated 19th June, 2002 issued by the respondentsociety to the RCS makes it clear that the said property was purchased by the petitioner from Dr. Tandon vide an agreement to sell registered on 19th August, 2005 and the society has approved her membership. 6.

Consequently, the present writ petition is disposed of with a direction to the RCS to place the name of the petitioner before the Rule 90 Committee with all the relevant papers for approval of membership to the respondent no. 2 Cooperative Group Housing Society.

The Rule 90 Committee shall consider the petitioner's case in accordance with law as expeditiously as possible preferably within three months. The rights and contentions of all the parties are left open.
