TR.P. (CRL) 17/2016 & CRL.M.A.4075/2016 (Stay) The present is a petition under Section 407 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'the Code') read with Section 482 of the Code seeking transfer of Appeal No.CA-3/16, titled as 'Sanjeev Kumar Mittal vs. The State' pending adjudication in the Court of Additional Sessions Judge, Patiala House Courts, New Delhi, to the Court of competent jurisdiction. Mr. Manjeet Singh Oberoi, learned APP appearing on behalf of the State invites my attention to a document dated 07.03.2016, authored by Mr. Mukul Kumar, Senior Public Prosecutor, to urge that in cases falling within the jurisdiction of Police Station- Vasant Kunj, where charges have already been framed and trial is underway, the same were to be retained in Saket District Courts, New Delhi.

In view of the foregoing, the present transfer petition is allowed. The Appeal No.CA-3/16, titled as 'Sanjeev Kumar Mittal vs. The State' pending in the Court of Additional Sessions Judge, Patiala House Courts, New Delhi stands transferred to the District & Sessions Judge (South), Saket Courts, New Delhi to be assigned to an appropriate Court, in accordance with law. The District and Sessions Judge, Patiala House Court, New Delhi is directed to transmit the papers and proceedings of the afore-mentioned appeal to District & Sessions Judge (South), Saket Courts, New Delhi on or before 08.04.2016.

The parties shall appear before the District and Sessions Judge (South), Saket Courts, New Delhi on 08.04.2016 at the first instance. With the above directions, the present transfer petition is allowed and disposed of accordingly. The pending application also stands disposed of. Copies of this order be sent to the District & Sessions Judge (South), Saket Courts, New Delhi as well as to the District & Sessions Judge, Patiala House Courts, New Delhi for necessary compliance. A copy of this order be given dasti under the signature of Court Master to counsel for the parties.
