% 01.03.2017 Learned counsel for the respondents state, she has taken instructions and according to the instructions, the petition filed by the petitioner under Section 74 (4) of the Delhi Reforms Act, 1954 is pending consideration of the Revenue Assistant/SDM. This aspect is conceded by the learned counsel for the petitioner, who states that the next date of hearing before Revenue Assistant/SDM is 1st May, 2017. If that be so, the petitioner cannot prosecute two parallel proceedings. Regrettably, it is noted, no averment with regard to the pendency of the proceedings before the Revenue Assistant/SDM, has been made in the writ petition. This itself is a ground to dismiss the

writ petition with cost. This Court refrains from doing so and dismiss the petition and application as proceedings under Section 74(4) are pending adjudication before the Revenue Assistant/SDM. V. KAMESWAR RAO, J MARCH 01, 2017 RN
