Petitioner impugns order dated 05.02.2018 whereby leave to defend application of the petitioner has been dismissed and an eviction order passed.

Respondent had filed the subject eviction petition seeking eviction of the petitioner from one shop on the ground floor of property bearing no. 2453, Naiwara, Chawri Bazar, Delhi, more particularly as shown in red colour in the site plan attached to the eviction petition.

Learned counsel for the petitioner submits that petitioner has surrendered his tenancy and handed over the peaceful vacant possession of the tenanted premises to the respondents on 25.02.2020 along with other portions in the same property which was being occupied by the petitioner pursuant to a settlement agreement dated RC.REV. 111/2018

Learned counsel for the petitioner seeks leave to withdraw the petition.
