This is a petition seeking grant of bail in FIR No. 92/2023, registered at PS Gulabi Bagh, chargesheet under Sections 397/411/34 IPC 2.
As per the charge sheet, it is stated that the petitioner along with a juvenile came from the back side of the complainant, caught the complainant from the back of his neck and took his mobile and wallet containing Rs. 500/-, AADHAAR Card and ATM Card. The petitioner had caught hold of the neck of the complainant and choked him as a result of which the complainant became unconscious.

The ATM Card of the complainant was recovered from the petitioner. 4.
To my mind, there was no weapon used by the petitioner. 5.
The petitioner has been in custody since 16.03.2023 and has spent a period of 1 year 8 months 22 days.

Keeping in view the gravity of the offence and keeping in view that the petitioner has already spent about more than 1 year 8 months in custody, the petition is allowed and the petitioner is directed to be released on regular bail in FIR No. 92/2023, registered at PS Gulabi Bagh subject to the following terms and conditions:
(a) The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Trial Court; (b) The petitioner shall appear before the concerned Court as and when the matter is taken up for hearing;
(c) The petitioner shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. The petitioner shall also provide his permanent residential address and in case of change of residential address or contact details, the petitioner shall promptly inform the same to the concerned IO as well as to the concerned Court; (d) The petitioner shall report to the local Police Station on the first Monday of every month;
(e) The petitioner shall not leave the country without permission of the concerned Court during the bail period and surrender his passport, if any, at the time of release before the concerned Court;
(f) The petitioner shall not directly/indirectly try to get in touch with any prosecution witnesses or tamper with the evidence. 8.
