The present matter has been received on transfer. 2.

The present writ petition has been filed inter alia with the prayer to declare the demolition action dated 11th June, 2014, as illegal and arbitrary. 3.

Learned counsel appearing for the petitioner submits that selective demolition action was taken by the Municipal Corporation of Delhi ("MCD") in respect of property no. 6/88, WEA, Padam Singh Road, Karol Bagh, New Delhi-110005.

In response, learned counsel appearing for the respondent no. 4-MCD submits, that there is no fresh construction in the subject property, and that action against the unauthorised construction was taken in the year 2014. 5.

Learned Senior Counsel appearing for respondent no. 10 submits that no fresh construction has been carried out.

Attention of this Court is also drawn to the reply of the Special Task Force ("STF") in the year 2025, wherein, the petitioner approached the STF, and it has been clearly stated by the STF that enforcement measures have already been taken under the provisions of the Delhi Municipal Corporation Act, 1957 and that as of today, the entire property is old and residentially occupied.

At this stage, learned Senior Counsel appearing for the respondent no. 10 submits that respondent no. 10 shall apply for regularization of the existing property, since there is no fresh construction having been undertaken by respondent no. 10.

Likewise, learned counsel appearing for the petitioner submits that the petitioner shall also apply to the MCD for regularization of the existing portion in the property occupied by the petitioner. 9.

The aforesaid statements are taken note of.

Accordingly, the petitioner as well as respondent no. 10, are granted liberty to file applications for regularization before the MCD. The MCD shall consider the said applications, in accordance with law. 11.

Both the parties, i.e., petitioner as well as respondent no. 10, are held bound to comply with any directions as may be issued by the MCD. 12.

In case of any excess coverage/non-compoundable deviations, directions shall be given by the MCD for removing the same, which shall be duly complied with, by the respective parties. 13.

Upon the non-compoundable deviations being removed by the respective parties, i.e., the petitioner and respondent no. 10, the MCD shall proceed to issue requisite orders for regularization of the respective portion of the property.

Accordingly, both the petitioner and respondent no. 10 shall make a requisite application before the MCD expeditiously, within a period of four weeks, from today.
