This petition challenges the order dated 12.11.2024 passed by the learned Presiding Officer, Appellate Tribunal, Municipal Corporation of Delhi [AT, MCD] .

The impugned order vacated the interim stay granted on 24.05.2024 and listed the matter for 18.03.2024 for arguments on the interim application.

Learned counsel for the petitioner submits that the impugned order was passed without granting opportunity of hearing at the back of the petitioner while he was held up in Supreme Court. After some arguments, learned counsel does not want to press the present petition.

In view of the request made by learned counsel for the petitioner, the petition is dismissed as withdrawn. However, petitioner is granted liberty to file an application before the ATMCD for early hearing of the interim stay application.

It is clarified that no observation has been made in this order on the merits of the case, and all rights and contentions of the parties on merits are left open.
