The petitioner has filed this petition for grant of divorce under Special Marriage Act, 1954 wherein she has filed an application under Section 36 of the Act for grant of interim maintenance, which is stated to be pending since 2021.

The learned counsel submits that the respondent/ husband has filed a separate petition under the Hindu Marriage Act, 1955 for the grant of divorce and both the petitions are being tried by the same Court. 3.

evidence in the divorce petition filed by the respondent while in the petition filed by the petitioner, it is listed for arguments on applications under Section 36 of the Special Marriage Act, 1954 and under Section 151 of CPC. 4.

The only prayer in this petition is for direction to the Court of learned Principal Judge, Family Courts, Patiala House, to dispose of the interim maintenance application within a period of one month. 5.

Since the learned Trial Court has already listed the matter for hearing arguments on application under Section 36 of the Special Marriage Act, 1954 for 09.12.2024, no further directions are required. However, it is expected that the learned Trial Court would hear the application on the date fixed and try to dispose of the application at the earliest. 6.

The petition accordingly stands dismissed.
