This application is filed by the Petitioner under Section 151 CPC seeking preponement of the date of hearing of the writ petition. 2.

For the reasons stated in the application, the same is allowed. 3.

With the consent of the parties, the writ petition is taken up for hearing.

This writ petition is filed by the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "(a) issue a writ order or direction in the nature of Mandamus directing respondent Nos.2 to 4 IndusInd Bank to issue the no objection certificate to the petitioner in respect of his commercial vehicle, bearing registration The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

number UP83CT4658 as well as in respect of commercial vehicle bearing registration number UP83CT4622 where in the petitioner had stood as a co-borrower.

(b) issue a writ order or direction in the nature of Mandamus directing respondent No. 1 to take the appropriate action against the respondent Nos. 2 to 6 bank for illegally and unlawfully and violation of its guidelines repossessing, the commercial vehicle of the petitioner bearing registration number UP83CT4658.

(c) issue a writ order or direction in the nature of Mandamus directing respondent Nos. 2 to 4 to pay Rs.25 lakhs as compensation to the petitioner for illegally and unlawfully repossessing above said commercial vehicle of the petitioner and to their failure to provide the no objection certificate in spite of the settlement of account in respect of commercial vehicle number UP83CT6422 where in the petitioner is a co-borrower. (d) issue a writ order or direction in the nature of certiorari quashing the sale or auction as the case, may be of the commercial vehicle of the petitioner bearing registration number UP83CT4658 by the respondent Nos. 2 to 5 bank illegally and unlawfully on the alleged default in repayment of the loan amount.

(e) Issue a writ or order in the nature of mandamus directing the respondent No.5 and 6 to pay the amount due against annexure P-1 (Colly) to the petitioner, if the same had not been paid, on account of death on wheels of Late Sh. Raja Bahadur Singh, father of petitioner, if the same had not been already paid.

(f) Pass any such or further order as this honorable court may deem fit and proper in the facts circumstance of the case." 6.

Counsels, as above, accept notice on behalf of the respective Respondents.

Learned counsel for Respondents No.2 to 4 takes an objection to the territorial jurisdiction of this Court on the ground that the entire cause of action has arisen outside Delhi.

Counsel for the Petitioner submits that this Court has territorial jurisdiction and that he will be able to substantiate this point. However, it is submitted that this Court need not go into the merits of the case since a complaint dated 12.06.2025 made to RBI Ombudsman is pending The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Counsel for RBI acknowledges the pendency of the complaint and submits that the same shall be considered and decided within four weeks from today.

Accordingly, without entering into the merits of the case and leaving the question of territorial jurisdiction open, this writ petition is disposed of recording the submission made on behalf of RBI that complaint dated 12.06.2025 made by the Petitioner will be disposed of within four weeks from today.
