This is an application filed by defendant no. 1 under Order VII Rule 11 of the Code of Civil Procedure, 1908 ['CPC'] seeking return of the plaint. 2.

Learned counsel for Defendant No. 1 states that he is also representing Defendant Nos. 2 and 3.

2.1 He submits that in view of the cause of action pleaded in the plaint and considering that the registered office of Defendant No. 2 is situated in Mumbai, the Courts at Mumbai, Maharashtra would have the territorial jurisdiction.

2.2 He states that Defendant No. 1 is a foreign entity and had engaged Defendant No. 2 for the manufacture of the alleged infringing goods, which forms the cause of action in the subject matter of the present suit. 3.

filed written submissions stating that it has no objection if the application is allowed and the plaint is returned with liberty to present the same before the court of appropriate jurisdiction. He as well states that the Plaintiff will approach the Courts at Mumbai, Maharashtra for presenting the plaint. 4.

In view of the aforesaid submissions of the Plaintiff and the Defendants, the application is allowed, and the plaint is directed to be returned to the Plaintiff, in accordance with the applicable rules, within a period of four (4) weeks, to be presented before the court of competent jurisdiction at Mumbai, Maharashtra.

With the aforesaid directions, the application stands disposed of. CS(COMM) 1026/2024 6.

The suit stands disposed of.
