Writ Petition under Articles 226/227 of Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of FIR No. 0376/2018 registered under Sections 377/342/323/324/498A/34 IPC at P.S. Ambedkar Nagar, Delhi and all the proceedings emanating therefrom in terms of the Mediated Settlement dated 05.06.2024.

It is submitted that marriage of Petitioner with Respondent No.2 was solemnized on 01.05.2009 as per Hindu Rites and Customs and out of their wedlock, two children were born. However, due to temperamental differences, Respondent No. 2 and the Petitioner started living separately. 3.

It is stated that on 18.08.2018, on the basis of complaint filed by the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Respondent No. 2, FIR No. 0376/2018 was registered under Sections 377/342/323/324/498A/34 IPC at P.S. Ambedkar Nagar wherein the Petitioner was implicated.

It is submitted that with the intervention of family members, relatives and well wishers, Petitioner and Respondent No.2 have resolved their disputes and arrived at an amicable settlement, terms whereof have been recorded in Mediated Settlement dated 05.06.2024. 5.

The parties are present in person in the Court and have been identified by their respective Counsel.

It is submitted by the parties that they have arrived at a settlement without any force, coercion and undue influence and pressure and they have signed the Mediated Settlement dated 05.06.2024 voluntarily with their wish and will.

Learned Counsel for Petitioner submits that the parties have been happily living together for the last one year and no grievance against each other survives and since Respondent No. 2 has already made a statement before the Court that she does not want to pursue the proceedings in FIR No. 0376/2018, the present Petition be allowed and FIR registered against the Petitioners be quashed.

Respondent No. 2 submits that she has no grievance against the Petitioners and also 'no objection' to the quashing of FIR. She affirms that she is happily living together with Petitioner.

In view of the fact that the FIR in question was premised upon a matrimonial dispute between Petitioner and Respondent No.2, which has been amicably resolved in term of Mediated Settlement dated 05.06.2024 and the fact that parties have been living together for last one year and also that The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Respondent No. 2 has given 'no objection' to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR.

Consequently, FIR No. 0376/2018 registered under Sections 377/342/323/324/498A/34 IPC at P.S. Ambedkar Nagar and proceedings emanating therefrom are hereby quashed.

The present Petition alongwith pending Application, is accordingly disposed of.
