Writ Petition under Article 226 of Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner-Shashi Bhushan for grant of Parole for a period of 04 weeks, who is presently undergoing his sentence which is about to end on 27.09.2026 in FIR No. 0490/1992 under Sections 302/397/120B/34 IPC at P.S. Hari Nagar.

It is submitted that the Petitioner's latest Parole from 26.09.2025 to 10.10.2025, which was the first spell. During the said period, he underwent medical evaluation as a prospective kidney donor for his wife and had undergone multiple diagnostic tests including Chest X-ray, 2D Echocardiogram, Abdominal Ultrasound (Whole Abdomen) and Fundus Examination.

During this period, his wife had undergone five Dialyses session from 27.09.2025 till 11.10.2025, demonstrating the genuineness and urgency of the medical exigency, for which Parole is sought. 4.
It is stated that the condition of wife of the Petitioner is critical as she has to undergo 03 dialysis sessions mostly in a week. The Petitioner has to undergo remaining medical examinations which are 24-hour Urine Albumin Test. Hence, he has sought Parole for a period of four weeks for undergoing the requisite Medical Tests.

The learned ASC for the State submits that his Parole Application has been filed on 12.10.2025, i.e. barely two days after his surrender on 10.10.2022 after availing the first spell of Parole. It is submitted that as per Rules, the circumstances do not justify his grant of Parole. 6.

The only ground on which emergent Parole is sought is that the Petitioner has to undergo certain Medical Tests, since he is a prospective Kidney donor to his wife.

As per the submissions of learned Counsel of behalf of the State, these tests can be done even in the Jail Dispensary. 9.
The test stated and other Medical Tests which may be required, be accordingly done at the earliest but definitely within a period of 03 weeks at Jail Dispensary or at Safdarjung Hospital or any other Hospital where the Tests are available.

With this observations, the Petition alongwith pending Applications, is disposed of.
