CRL.M.A. 4614/2026 By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the applicant/petitioner seeks extension of parole granted vidé order dated 04.12.2025 by a Co-ordinate Bench for a period of 04 weeks, which period is running-out tomorrow i.e., 11.02.2026.

Learned counsel appearing for the petitioner submits, that a rod had been implanted in the petitioner's leg, which has now been removed at a government hospital; and the doctors have advised him rest for 02 months, which will not be possible in custody.

Counsel submits, that the petitioner has completed about 09 years and 03 months, out of 13 years of sentence awarded to him. Issue notice.

Mr. Sanjay Lao, learned Standing Counsel (Criminal) appears on behalf of the State on advance copy; accepts notice; and seeks time to verify the documents; and file status report.

Let the documents appended to the application be verified and status report to that effect be filed before the next date; with copy to the opposing counsel.

Re-notify on 13th February 2026.

In the meantime, the parole granted to the petitioner vide order dated 04.12.2025 shall remain extended, till the next date of hearing before this court.
