% 10.03.2016 The present is a petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'the Code'), seeking quashing of FIR No.0088/2016 dated 25.02.2016 under Section 365 IPC registered at Police Station- Karawal Nagar, Delhi.
The facts as are relevant for the disposal of the present petition are that the petitioner married Zainab Parveen daughter of Nisar Ahmad on 23.02.2016. Zainab Parveen, who is present in court and has been identified by the IO in the subject FIR, namely, ASI Shiv Shanker, Police Station- Karawal Nagar, Delhi, states that she is an adult and that her date of birth is 22.09.1995. Zainab Parveen further states that she left her parental home and married the petitioner of her own free will and desire. The IO in the subject FIR states that a statement under Section 164 of the Code in this behalf of Zainab Parveen has already been recorded before the concerned Magistrate on 08.03.2016. Ms Richa Kapoor, learned Additional Standing Counsel (Crl.), on
instructions from the IO in the subject FIR, states that in view of the aforesaid statement the police contemplates to file a cancellation report qua the subject FIR within a period of four weeks from today. At this juncture, it would be relevant to observe that the subject FIR was registered on the basis of a complaint filed by respondent No.2, the brother of the said Zainab Parveen.
In view of the above statement made on behalf of the police while directing them to comply with the said statement in accordance with law, the present petition is disposed of.
