% 19.03.2018 It is submitted that petitioners and respondent no. 2 have settled their disputes vide a Memorandum of Understanding/Settlement Deed dated 6th March, 2018; therefore, FIR No.366/2016 under Sections 323/325/34 IPC registered at Police Station Subzi Mandi on the complaint of respondent no. 2, which is at the investigation, may be quashed. It is further submitted that a cross FIR No. 341/2016 under Sections 354/323/341/34 IPC was registered against respondent no. 2 (complainant herein) on the complaint of petitioner no. 1 Neeraj Goyal (accused). Both the cases have been settled between the parties amicably. Respondent no. 2 Shri Umesh is present in

Court along with his counsel and has been identified by SI Dhan Singh of police station Subzi Mandi. Respondent no. 2 submits that he has settled the matter with petitioners of his own free will and without any undue force, pressure or coercion and has no objection in case FIR is quashed against the petitioners.

Keeping in view the settlement arrived at between the petitioners and respondent no. 2, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, in the interest of justice, FIR No.366/2016 under Sections 323/325/34 IPC registered at Police Station Subzi Mandi, which is at the investigation stage, is quashed. Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
