O R D E R

% 13.03.2018 The petitioner's grievance is that a public pathway, in khasra No.166 is sought to be blocked by the Delhi Development Authority (DDA) citing directions of this Court in W.P.(C) No.4302/2015 (INTACH v. Delhi Development Authority & Ors.). It is contended that the complete blocking of ingress and egress to a Mosque, was not contemplated by the Court's order. W.P.(C) 2331/2018

The Court has considered the materials on record including the photographs and the plans. The orders of the Court were made in the context of the overall situation that exists on the ground where several unauthorized constructions were noticed. The DDA's proposal to provide restricted entry to those wishing access to the Mosque, cannot therefore be termed as illegal or unreasonable. In case the petitioner wishes to make any reasonable request (which shall not include raising construction or any permanent structure within the prohibited area or the areas under the control of the DDA), it may approach the DDA in that regard. The DDA shall consider the reasonableness of any such request and pass appropriate orders.
