O R D E R

% 16.01.2019 Petitioner seeks pre-arrest bail in F.I.R. No. 928/2016 under Sections 498A/506/354/406/34 IPC registered at police station Nihal Vihar, Delhi.

While entertaining this application, interim protection was granted to petitioner from arrest as he volunteered to pay the maintenance and vide last order petitioner had undertaken to clear the arrears of interim maintenance.

Learned counsel for petitioner submits that due to financial stringency, the arrears of maintenance could not be paid and today ₹20,000/- in cash has been handed over to complainant who is present in BAIL APPLN. 615/2018

the Court. Learned counsel for petitioner on instructions submits that the arrears of maintenance would be cleared in installments of ₹ 20,000/- per month and the current maintenance would also be paid regularly. It is stated that the arrears of maintenance would be positively cleared by July, 2019.

It is also stated that the aforesaid undertaking by way of an affidavit would be placed on record within a period of one week from today.

Upon hearing and on perusal of the F.I.R. and the status report, interim order of 20th March, 2018 is made absolute, subject to petitioner complying with the aforesaid undertaking given to this Court. In the event of arrest, petitioner be admitted to bail, subject to his furnishing bail bond in the sum of ₹ 20,000/- with one local surety in the like amount to the satisfaction of the trial court. It is made clear that in case of any two consecutive defaults, the State/complainant of this F.I.R. shall be at liberty to get this order revoked.

The bail application is accordingly disposed of with the aforesaid terms.
