% 15.03.2017 Mr. Sanjoy Ghose, learned counsel appearing for the respondents states that he has instructions from the concerned Deputy Commissioner that the Appeal shall be disposed within six months. This Court is not agreeable to the period as suggested inasmuch as it is noted from the writ petition, the earlier writ petition being W.P.(C) 6148/2016 filed by the petitioner, was disposed of on 19th July, 2016, noting the remedy lies with the Deputy Commissioner. The appeal having been filed on the same day, almost 8 months have passed and on 5 dates no hearing took place. This Court is of the view that concerned Deputy Commissioner shall dispose of the Appeal within 3 months from today.
The petition and the connected application stands disposed of. Although the Court wanted to fix a date of hearing before the Deputy
Commissioner, in the absence of his convenience, the Court directs in the first instance the Deputy Commissioner shall fix a date of hearing within 15 days from today and intimate the same to the petitioner / department. Dasti.
