From the impugned order passed and the averments made in the writ petition it is apparent that the respondents have not considered the applicability of a decision dated March 30, 2001 of the Supreme Court in Appeal (Civil) 6166/1999 Union of India & ORs. vs. Rakesh Kumar as also a decision dated February 02, 2011 of this Court in W.P.(C) No.7410/2009 Sri Krishan vs. Union of India & Ors.

Noting representation made from the side of the respondents, the writ petition is accordingly disposed of at the admission stage itself directing that the respondents shall treat the instant writ petition as representation and considering the aforenoted judgments shall pass a fresh speaking order.
