O R D E R
% 27.09.2016 IA 1772/2016 (u/O. 6 R.17 CPC) After hearing for some time on the application under Order 6 Rule 17 CPC seeking to once again enhance the value of the relief claimed for purposes of jurisdiction and court fees, the learned counsel for the plaintiff submits that he withdraws the application and presses for transfer of the suit to the District court on account of change of the pecuniary jurisdiction though seeking liberty to move an appropriate application before the said court including on the subject of jurisdictional value.
The application is dismissed as withdrawn with liberty as prayed for.
CS(OS) 1378/2014 Having regard to the value of the relief for purposes of jurisdiction, the case is transferred to the file of the District Judge (West), presiding over West District Courts of Delhi at Tis Hazari. CS(OS) 1378/2014
The parties shall appear before the learned District Judge (West) on 02.11.2016. The learned District Judge (West) may in his discretion retain the file on his board or make it over to the court of additional district judge of the same district for further proceedings in accordance with law.
