Bail Appl. No. 364/2017 By this petition filed under Section 438 read with Section 482 of Cr. P.C., the petitioner is seeking anticipatory bail in a case registered vide FIR No.40/2017 under Section 354/354(B)/323/509/506/34 of IPC, at Police Station Mayur Vihar, Phase I, Delhi.

Mr. M.S. Oberoi, Additional Public Prosecutor accepts notice of the petition on behalf of the State and submits that the notice under Section 41 of Cr. P.C. has been issued to the petitioner and the same has been served on the father of the petitioner. In view of the aforesaid facts and circumstances, this court is of the opinion that the notice to the petitioner to join the investigation has been issued and there is no apprehension of arrest, therefore, the present bail application filed by the petitioner lacks merit and is hereby dismissed.
