The petitioner, vide the instant writ petition seeks quashing and setting aside of FORMAT-I (Annex-P1) of circular dated 11.11.2024 read with Clause 4 of the said circular to the extent of not providing a module to enable the schools to admit more than 25% students of the strength of the class as permitted under Section 12(1) (c) of the Right Of Children To Free And Compulsory Education Act, 2009.

Learned counsel appearing on behalf of the petitioner makes various submissions to claim the aforesaid relief. is necessarily required to be made in the module. 3.

The Court, therefore, at this stage, instead of entertaining the instant writ petition, directs the petitioner to make a proper representation substantiating the prayer as to why such a request must be acceded to by the respondent-Directorate of Education within a period of three days from today. If the petitioner does so, let the same be dealt with, by the concerned Directorate with due expedition within a period not exceeding 15 days from the date of receipt of the said representation. 4.

If an order passed in the said representation by the concerned respondent is adverse to the petitioner, the petitioner shall be at liberty to take appropriate recourse in accordance with law. 5.

With the aforesaid liberty, the instant petition stands disposed of along with the pending application.
