O R D E R

The present petition has been filed under Section 483 BNSS seeking interim bail in connection with FIR No. 195/2023 under Sections 302/307/120B/147/148/149/34 IPC read with Sections 25/27 of Arms Act registered at Police Station R.K. Puram on medical grounds. 2.
The learned Senior Counsel for the petitioner submits that the interim bail has been prayed for on the ground of medical condition of the petitioner's wife who is suffering from cancer. 3.
This Court had issued notice on 20.11.2024 and had directed the State to file its Status Report.

Subsequently, in the order dated 16.01.2025 this Court noted that a Medical Board has been constituted by Vardhman Mahavir Medical College and Safdarjung Hospital, New Delhi vide letter dated 15.01.2025.

Accordingly, directions were given to the Medical Board to expedite the examination of the patient and the IO was directed to place on record the report of the Medical Board. The Status Report has been handed over at Bar and the same is taken on record.

A perusal of the Status Report shows that the Medical Board has opined that the petitioner's wife is suffering from stage-IV cancer and she requires treatment as chemotherapy and targeted therapy. 6.
In view of the above, this Court is of the view that purely on humanitarian ground, the petitioner is entitled to interim bail. Accordingly, it is directed that the petitioner be released on interim bail for a period of four weeks after 10.02.2025 subject to his furnishing a Personal Bond in the sum of Rs. 25,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions:- a) Petitioner shall appear before the Court as and when the matter is taken up for hearing.
b) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.
c) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. d) Petitioner shall furnish the medical record of his wife on a weekly basis to the I.O concerned.

Upon expiry of period of four weeks as stated above, the petitioner shall surrender before the Jail Superintendent. 8.
The petition stands disposed of.
