This petition has been filed by the petitioner praying for the following reliefs:- "a. issue a Writ in the Nature of Mandamus and/or any other appropriate writ, Directing the Respondents to Expedite the hearing of the Original Application No. 259 of 2021 pending before the Ld. Armed Forces Tribunal, Principal Bench, West Block-8, RK Puram, New Delhi; and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. b. Stay the operation of the Order dated 05.10.2020 pending the disposal of the original application no. 259 of 2021;"

From the perusal of the petition, we do not find that the petitioner has approached the learned Armed Forces Tribunal („Tribunal‟) for having expeditious disposal of the Original Application, that is O.A. No. 259/2021, that has been filed by him and is pending adjudication before the learned Tribunal, or any interim relief therein.

In our view, without approaching the learned Tribunal for the said relief, the present petition is clearly pre-mature and is liable to be dismissed. The petition is, accordingly, dismissed.
