O R D E R

By way of present bail application, the applicant seeks regular bail in FIR No. 366/2024 registered under Sections 420/468/471/120B/34 IPC at P.S. Mundka, Delhi.

Learned counsel for the applicant submits that applicant is in custody since 22.10.2024 and the charge-sheet already stands filed. He further submits that till date, there is no material collected against the applicant besides the disclosure statement of the co-accused. He also submits that the co-accused against whom the allegations are levelled and money transactions are also found, has already been released on regular bail. 3.

Ld. APP for the State, duly assisted by learned counsel for the complainant, has opposed the bail application. He submits that the applicant was the Assistant Store Manager while the co-accused Anuj Savita was the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Store Manager. It is stated that both of them are involved in selling the raw material of the complainant's factory in Kanpur, U.P. It is further submitted that the aforesaid act of the accused persons has resulted in loss of about Rs.2.5 crores to the complainant.

I have heard the learned counsels for the parties and perused the material on record.

On a specific query as to what is the material collected so far against the present applicant, it is submitted that so far, only disclosure statement of the co-accused points to the complicity of the present applicant in the commission of the offence. It is also noted that there are no money transactions found in the account of the present applicant. Considering the aforesaid facts and circumstances and also the fact that the charge-sheet stands filed, this Court deems it fit to release the applicant on regular bail subject to him furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/concerned Court/Duty J.M. and subject to the following further conditions :- i) The applicant shall not leave the NCR without prior permission of the concerned Court.

ii) The applicant shall provide his mobile number to the Investigating Officer on which he will remain available during the pendency of the trial. iii) In case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned Investigating Officer as well as to the concerned Court.

iv) The applicant shall not directly/indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

v) The applicant shall regularly appear before the concerned Court during the pendency of the trial.

The bail application is disposed of in the above terms. 7.

Copy of the order be communicated to the concerned Jail Superintendent for information and necessary compliance. 8.

Needless to state that the observations made hereinabove are only for the purpose of disposal of present bail application and which shall not have a bearing on the trial of the case.
