By way of present application, the applicant who is an undertrial in FIR No. 863/2021 registered under Sections 302/120-B/201/34 IPC and Sections 25/27 of the Arms Act at P.S. Seemapuri, Delhi seeks release on interim bail for a period of one month on account of mental ailment of his wife.

Learned counsel for the applicant submits that applicant's wife is under treatment with IHBAS for uncontrolled behaviour which has led to severe assault on their two minor children. The application is accompanied by medical documents of the treatment undertaken by the applicant's wife as well as the minor children. It is further submitted that the medical documents of the applicant's wife have also been verified. The nominal roll of the applicant is also placed on record, as per which, the applicant was released on interim bail from 09.06.2023 to 02.07.2023. It is also informed that all the eye witnesses already stand examined. As per the report dated 02.12.2024 issued by IHBAS, which is handed over in Court alongwith the Status Report and taken on record, it has been stated that the follow up of the applicant's wife was lastly conducted on 22.11.2024 and that she was admitted on three previous occasions, i.e., from 24.12.2022 to 05.01.2023, 03.06.2023 to 10.06.2023 and 09.10.2024 to 29.10.2024.

Considering the medical condition of the applicant's wife which has been verified as per the Status Report, it is directed that the applicant be released on interim bail for a period of four weeks from the date of his release, subject to his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/concerned Court/Duty Judicial Magistrate/Link Judicial Magistrate and subject to the following conditions :- i) The applicant shall not leave the Delhi NCR without prior permission of the concerned Court;
ii) The applicant shall provide his mobile number to the IO on which he will keep operational and remain available during the period of his release; iii) The applicant shall report to the IO/SHO of the concerned police station on every Monday and Friday during the period of interim bail period; iv) The applicant shall not directly/indirectly try to get in touch with the prosecution witnesses or tamper with the evidence; v) The applicant shall surrender after the expiry of the interim bail period.
