% 08.03.2016 CRL.M.A.4133/2016 (Exemption) Exemption granted subject to all just exceptions. The application is disposed of accordingly.

W.P.(CRL) 738/2016 The present is a petition under Articles 226 and 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) praying as follows:- "

It is, therefore, most humbly and respectfully prayed that this Hon'ble Court may graciously be pleased to: A. Issue a writ of mandamus or any other appropriate writ directing the respondent No.1 to 4 to protect the petitioner's right to life and liberty; and/or B. Any other order/directions in the afore-mentioned facts and circumstances which this Hon'ble Court deems fit, proper and just may kindly also be passed, in the interest of justice."

Ms. Richa Kapoor, learned Additional Standing Counsel (Criminal) appearing on behalf of the official respondents on advance notice, on instructions from the IO in the subject FIR namely, SI Neeraj Kumar, Police Station- Mandawali states that without prejudice to the rights and contentions qua the averments made in the present petition, in view of the circumstance that the petitioner is an elderly lady, who is living alone, the police has already afforded adequate protection to her; sensitized the beat constable of the concerned area in this behalf; and the telephone number of the Division Officer of the concerned police station as well as the beat constable has already been provided to the petitioner. Ms. Kapoor further states that the telephone number of the SHO of the concerned Police Station shall also be provided to the petitioner forthwith in order to enable the latter to contact the former in the event of any threat or apprehension.

Directed accordingly.

In view of the direction that is being issued hereinabove, I do not think it necessary to issue notice to respondent Nos.5 to 7 in the present petition. With the above directions the writ petition is disposed of. A copy of this order be given dasti under the signature of Court Master to counsel for the parties.
