% 08.08.2016 Status report has been filed by respondent No. 2. This Court notes that respondent No. 2 is the main contesting respondent. In this status report, it is stated that the property in question i.e. E-5 to 7, Kamla Nagar, Geeta Bhawan Dharamshala, Delhi was inspected on 23.05.2016. On inspection, it would found that the property consisted of ground floor (six shops), first floor, second floor and third floor. No sanction plan could be shown by the occupier/owner. Action under Sections 343/344 has been initiated. The unauthorized construction was booked on 23.05.2016. Show cause notice has been issued. FIR to that effect has also been lodged. In this report, it is
further stated that the six shops on the ground floor are being used for commercial purposes with paying the necessary conversion/misuse charges. Violations of MPD 2021 have been carried out. Respondent No. 2 states that certain representations were made by the occupier/owner and he was given a personal hearing and he has shown certain documents prior to 1954 which are under examination but if the deviations are continued to be noted by the private respondents, all actions in accordance with law shall be taken. This later part of the submission of respondent No. 2 is not a part of status report but it is made to the Court under instructions from Mr. Suresh Dua, Assistant Engineer (Civil Lines). This submission is taken on record. It is hope and expected that all actions in accordance with law shall be taken and the same shall then be intimated to the petitioner. No further orders are called for on this petition. It is disposed of.
