After some submissions, learned counsels for parties pray that matter be remanded back to the Ld. ARC for fresh consideration of leave to defend application on merits.

Learned counsel for the petitioner, on instructions, also submits that without prejudice to the rights of the petitioner concerning the claim of ownership, the petitioner would pay a sum of Rs.3,000/- per month to the respondent alongwith arrears within a period of one month from today. 3.
