O R D E R

% 14.03.2018 We have heard counsel for the parties.

The appellant had sought limited parole on the ground that 17th ceremony of his maternal grandmother had to be undertaken and that he wanted to be with his family. The Single Judge rejected the petition (that challenged the order of the Jail authorities).

Considering that the appellant has undergone more than 17 years actual incarceration (of the 21 years undergone including remission), this Court is of the opinion that discretion can be granted in this case for a short duration. Accordingly, the appellant shall be enlarged on parole, for four days effective from the date of LPA 110/2018

release and shall surrender to the balance of the sentence by 5 p.m. on the fourth day. The appellant shall furnish a personal bond with one surety to the satisfaction of the Jail Superintendent to the tune of `5,000/-. The order shall be communicated by the Registry to the concerned Jail No.2 Tihar directly and forthwith.

The necessary steps to apprise the Jail Superintendent by fax shall also be undertaken.

The appeal is allowed in the above terms.
