% 14.05.2015 This is an appeal directed against the order dated 02.02.2015 whereby the applications [I.A No. 22503/2014 (for restoration of the suit) and I.A No. 22505/2014 (for condonation of delay in filing the application for restoration)] were dismissed by a learned Single Judge of this Court.

We have heard the learned counsel for the parties. We set aside the impugned order and direct that the suit be restored.

This is, however, subject to the appellant paying costs of Rs 10,000/- to the respondents. The said costs be paid within a period of two weeks. The suit be listed before the learned Single Judge in the first instance on 06.07.2015 for directions.

The appeal stands allowed as above.
