This is a petition seeking bail in FIR No. 375/2024, charge-sheet under Sections 393/398/307/308/120B/201/34 of IPC and under Section 27 of the Arms Act, registered at PS Model Town. 2.
It is stated that one Naman Jain was wanting to deal in crypto currency and had taken Rs. 3.5 lakhs in a bag. As per the FIR, the allegation against the petitioner is that the petitioner along with two other co-accused, namely Neeraj @ Nikku and Vinay @ Laddu met the complainant and the petitioner tried to snatch the bag containing Rs. 3.5 lakhs from the complainant. The complainant resisted and held on to the bag, as a result of which, Vinay @ Laddu attacked the complainant with a knife on the chest. 3.
Subsequently, in view of the resistance offered by Naman Jain, all the three accused persons fled from the scene without taking the bag containing an amount of Rs. 3.5 lakhs.

In the present case, the other co-accused namely Neeraj @ Nikku, has already been granted bail on 03.08.2024 by the Sessions Court. 5.
The petitioner is in custody since 14.06.2024. 6.
I am of the view that since the co-accused who was present on the site along with the petitioner has already been granted bail, and the petitioner has already been in custody for more than 4 1⁄2 months, the petitioner is entitled to bail.

The petitioner is a 22 years old boy and has clean antecedents and there is no other criminal case registered against the petitioner. The petitioner has parents to look after.

The petitioner was granted bail earlier and he duly complied with all the bail conditions.

Hence, I am inclined to allow the petition.

For the said reasons, the petition is allowed and the petitioner is directed to be released on bail in FIR No. 375/2024 registered at PS Model Town, subject to the following terms and conditions: (a) The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Trial Court; (b) The petitioner shall appear before the concerned Court as and when the matter is taken up for hearing;
(c) The petitioner shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. to the concerned IO as well as to the concerned Court; (d) The petitioner shall not leave the country without permission of the concerned Court during the bail period and surrender his passport, if any, at the time of release before the concerned Court;
(e) The petitioner shall not directly/indirectly try to get in touch with any prosecution witnesses or tamper with the evidence. 11.
The petition stands disposed of in the aforesaid terms. 12.
