several disputed questions of fact and, therefore, determination of such an issue would neither have been possible, nor permissible in law, learned counsel for the appellant states that the appellant may be permitted to withdraw this appeal with liberty to institute a suit for redressal of his grievances before a Court of competent civil jurisdiction. 7.

Accordingly, the appeal is dismissed as withdrawn with the liberty as prayed for. We, however, state that the liberty to the appellant to take recourse to remedy of filing a civil suit is being granted only if, it is otherwise available to him in law.
