The appellant/applicant having not challenged the preliminary decree of partition opted to challenge the final decree and then sought permission to withdraw the appeal with liberty to file fresh appeal. Now the applicant seeks refund of the court fees. Opportunity is granted to address with the help of relevant statutory or judicial pronouncements that the court fees can be refunded even in a case where the dispute is not resolved through ADR or otherwise compromised.
