% 12.04.2018 The grievance of the petitioner is that the respondent-Municipal Corporation of Delhi adopted a completely ad-hoc approach and did not follow the recruitment rules in regard to the promotion/posting of the Deputy Commissioners.

The petitioner highlights that majority of the incumbents lacked the basic qualification to discharge their duties but nevertheless were permitted to do so for a long stretch of time and subsequently even earned higher postings.

The petitioner had sought directions, including those in the nature of a writ of quo warranto, to impugn the appointments of the contesting respondents, some of whom are no longer in service and some have even died.

In these circumstances, the dispute has been rendered academic. At the same time, this Court notes that the adoption of any ad-hoc or stop gap arrangements ought not to be for a long term period and should be within the defined parameters, as otherwise, it will inevitably result in loss of morale to deserving officers.
