% 17.01.2018 Learned counsel for the petitioner says that in view of the settlement arrived at with the respondent company he has instructions to withdraw the caption petition. The company petition and pending application is dismissed as withdrawn in view of the submissions made above. Liberty, though, is given to the petitioner to revive the Company Petition in case there is default in payment by the respondent company.
