The prime and foremost contention coming from the side of learned counsel for applicant is to the effect that the present case, which is largely based on various circumstances, does not stand proved, in view of the testimony of material witnesses i.e. PW-5-Uday Bhan and PW-10-Jitender Kumar.

The applicant is, reportedly, 20 years of age and is incarceration for more than one and a half years.

However, after hearing arguments for some time, learned counsel for applicant, without prejudice to his rights and contentions, does not press the present application, at this stage.

He, however, submits that the request be made to learned Trial Court to expedite the recording of the remaining witnesses as the material public witnesses have already been examined and according to him, nothing substantial is going to be revealed by the remaining witnesses. 5.

The next date of hearing before the learned Trial Court is stated to be 11.04.2026.
