Learned counsel for the parties submitted that since the petitioner has paid Rs.1,33,000/-, i.e., 50% of the total amount, hence, the impugned order dated 22.1.2018, passed by the Appellate Court, may be set aside and the Appellate Court may be directed to hear the appeal on merits.

Accordingly, in view of the aforesaid circumstances, the impugned order dated 22.1.2018, passed by the Appellate court, is set aside and the Appellate Court is directed to hear the appeal on merits. The parties are directed to appear before the Appellate Court on 9.12.2019 at 10:00am.

Petition is disposed of in above terms. Pending application is also disposed of.
