The present writ petition has been filed seeking directions to the respondent no. 1 to take legal action against the respondent nos. 2 and 3 against the encroachment and unauthorized construction being carried out by them in properties no. 1637-1639, Main Bazar, Paharganj, New Delhi110055. 2.

Responding to the present writ petition, learned counsel for the respondent no. 1, i.e., Municipal Corporation of Delhi ("MCD"), has handed over to this Court documents pertaining to grant of sanction of building plan with respect to the properties in question, in the name of one Sukhwinder Kaur.

Learned counsel for the respondent no. 1-MCD submits that sanction of building plan has been granted in favour of aforesaid Sukhwinder Kaur for properties in question. MCD, Sukhwinder Kaur is the owner of the property in question and not respondent nos. 2 and 3.

At this stage, learned counsel for the petitioner submits that the construction which is being carried out in the property in question has resulted in encroachment of the common passage. 5.

Accordingly, MCD is directed to inspect the property and to ensure that any construction which is carried out, is as per the Sanctioned Building Plan.

In case of any excess coverage or deviation from the Sanctioned Building Plan, appropriate action shall be taken by the MCD in accordance with law.

Rights and contentions of the parties are left open. 8.

In case any party is aggrieved by any action or non-action on the part of the MCD, their remedies in accordance with law, is reserved. 9.

With the aforesaid directions, the present writ petition, along with the pending application is disposed of.
