Upon notice being issued in the writ petition Mr. Abhishek Vikas, learned counsel, who appears for respondent no. 2 has reverted with instructions. As to what those instructions were is noted hereinbelow. 2.
The substantive prayers made in the writ petition are as follows:- "(a) Direct the respondent no. 1 to report that the petitioner is the only surviving member of deceased Late Devidass Tewani and/or (b) Direct the respondent no. 2 to remit the lease amount of the deceased husband in the account of the petitioner having account no. 4447000100093183 and/or"

In the context of the above Counsel for the respondent no.2 states that he has instructions to convey to the Court that an enquiry has been made which brought to the light the fact that the petitioner is the sole surviving legal heir of late husband, who had leased the subject property to the respondent no.2.

Given these circumstances, counsel for the respondent no.2 states that rent has been released pursuant to the enquiry in favour of the petitioner and that an attempt is being made to execute a fresh lease deed with the petitioner.

Having heard the statement of the counsel for the respondent no.2, Mr. Rajesh Rai, learned counsel for the petitioner states that he does wish to press the petition any further. Accordingly, the petition is dismissed as not pressed.
