Transfer, under Section 24 of the Code of Civil Procedure, 1908, is sought of HMA No.1295/2016 titled Anshuman Narang Vs. Ritika Juneja Narang of the Court of Principal Judge, Family Court, Saket, New Delhi to the Court of Principal Judge, Family Court (North-West), Rohini, Delhi on the ground of the petitioner residing closer to the Rohini Courts. 2.

Notice of the petition was ordered to be issued and the counsel for the respondent appears and opposes the transfer. It is contended that the petitioner has been attending other proceedings between the parties pending in this Court and the distance from the residence of the petitioner to this Court is the same as the distance to the Saket Courts. It is argued that once the petitioner can travel to this Court, she can also travel to Saket Courts. 3.

On enquiry, it is however admitted that some other proceedings are already pending in the Court of Principal Judge, Family Court (North West), TR.P.(C.) 40/2017

In this view of the matter, the petition is allowed; HMA No.1295/2016 titled Anshuman Narang Vs. Ritika Juneja Narang is transferred from the Court of Principal Judge, Family Court, Saket, New Delhi to the Court of Principal Judge, Family Court (North-West), Rohini, Delhi.

The Transferor Court is requested to physically transfer the suit file forthwith.

The parties to appear in the transferred proceedings before the Transferee Court on 20th December, 2017, when other proceeding already pending before that Court is stated to be listed. RAJIV SAHAI ENDLAW, J.
