The present petition has been filed under Article 226 of Constitution of India read with Section 528 of BNSS, 2023 seeking quashing of FIR No. 0457/2025 under Sections 115(2)/74/126(2)/3(5) BNS 2023 registered at Police Station K.N. Katju Marg, Rohini, Delhi and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement.

The petitioners, as well as, respondent no. 2/complainant are present in the Court and they have been identified by their respective counsel, as well as, by the Investigating Officer i.e. PSI Ritika, P.S. K.N. Katju Marg, Rohini, Delhi.

The case set out in the petition is that the petitioners and respondent no.2/complainant are known to each other as they belong to the same locality and had cordial/neighbourhood relations in the past. However, certain misunderstandings and a heated altercation took place between them, which led to registration of aforesaid FIR at the instance of respondent no.2. 8.

It is stated that during the pendency of present proceedings, with the intervention of respectable members of the society, the parties have arrived at a settlement, terms whereof have been reduced in writing in the form of Memorandum of Understanding-cum-Settlement Deed dated 09.10.2025 which is annexed as Annexure P-2 to the present petition. 9.

On a query posed by the Court, respondent no.2/complainant, who is present in Court, affirms the factum of settlement and states that she has no objection in case the aforesaid FIR is quashed. 10.

In view of the settlement between the parties, the ultimate chances of conviction in the case are bleak, therefore, continuation of criminal proceedings will not serve any useful purpose and it will be an exercise in futility.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 12.

Consequently, the petition is allowed and the FIR No. 0457/2025 under Sections 115(2)/74/126(2)/3(5) BNS 2023 registered at Police Station The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

K.N. Katju Marg, Rohini, Delhi and all consequential proceedings emanating therefrom, is quashed.
