A Petition under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioners for Quashing of FIR No.441/2025 under Section 110/3(5) BNS registered at Police Station Ashok Vihar, Delhi.

The facts as stated in the Chargesheet are that on 16.08.2025 the Complainant Vinay was beaten up by some boys. The PCR reached the spot and took the Complainant to DCB Hospital. On the Statement of the Complainant, FIR No.441/2025 under Section 110/3(5) BNS was registered against the Petitioners.

It is submitted that the present has been filed through Parokar, as the Petitioner No.1 is in Judicial Custody since 16.08.2025 and Petitioner No.2 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. since 15.09.2025. The Respondent No.2 Vinay Kumar is present in person and submits that he is neighbour of the Petitioners and are regular visitors. The sudden quarrel ensued on account of some misunderstanding, wherein the Complainant was beaten up by danda and a large spoon. He suffered a fracture of left arm. It is submitted that because of their relationship of being neighbours and due to the intervention of family and friends, they have settled all their disputes voluntarily and without any fear, force or coercion and that they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed. 6.

The Complainant is present in the Court and submits that the matter stands settled with both the Accused who have filed the present Petition. He has no objection if the FIR is quashed against the petitioners, on account of the settlement already arrived at between the parties. 7.

The Petitioners through Parokar and Respondents No.2 are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 441/2025 registered at Police Station Ashok Vihar, for offences punishable under Sections 110/3(5) BNS with all the subsequent proceedings and the charge sheet is hereby quashed qua both the accused persons/Petitioners herein.
