Learned counsel for the petitioner submits that the Investigating Agency, in its status report which had been filed before the learned Special Judge (NDPS), Dwarka Courts, has not made mention of a DVR that stands yet to be recovered from the petitioner, while the status report filed before this Court claims that a missing DVR is a attributable to the petitioner and its recovery is awaited.

On a query by this Court, neither the learned APP, nor the IO, are able to furnish a viable explanation as to why the factum of the missing DVR has been brought up at this belated stage.

present in person, claims to have intimated the concerned IO about the missing DVR soon after the occurrence of the alleged incident. 4.
This Court is of the view that the alternating stands taken by the prosecution before the learned Special Judge and before this Court has the effect of casting a shadow of doubt over its case, specifically with respect to the quantum of a recoverable DVR. Furthermore, investigation has been ongoing for around 8 months.

For the aforesaid reasons, and given that investigation has nearly been concluded, this Court deems it appropriate to enlarge the petitioner on bail in the event of his arrest in connection with FIR no. 175/2025 dated 14.03.2025 registered at Police Station Dwarka, Delhi, under Section 118(1) of the Bharatiya Nyaya Sanhita, 2023, upon his furnishing of a personal bond to the sum of ₹ 25,000/- with one solvent surety of the like amount to the satisfaction of the IO/learned Trial Court concerned on the following terms and conditions:
a) The petitioner shall remain available on the mobile numbers shared by him with the Police.
b) The petitioner shall not leave the country without prior permission of the concerned Court.
c) The petitioner shall join the investigation as and when directed by the concerned IO.
d) The petitioner shall not directly or indirectly make any attempt to influence the witnesses or tamper with the evidence in any manner. e) In case of change of residential address or contact details, the petitioner shall promptly inform the same to the concerned SHO/IO. 6.
