At the outset, Dr. Sarbjit Sharma, counsel appearing on behalf of the plaintiffs seeks to withdraw the present suit with liberty to file a recovery suit.

In view thereof, the present suit is dismissed as withdrawn, with the aforesaid liberty.

Since the suit has been withdrawn on the first hearing itself, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiffs, in terms of Section 16 of the Court Fees Act, 1870, read with Section 89 of the Code of Civil Procedure, 1908.
